Certified Record - A written record certified by the individual, office or agency creating the record. A criminal history check obtained through the Nebraska State Patrol will be certified and will bear the Nebraska State Patrol seal.

Disposition - Dispositions are the result of the adjudication process and may include convictions, null pros, acquittals and nullified convictions through set-asides and pardons.

Maiden Name – The legal last name issued to an individual at birth.

No Record – There are no criminal records to be released.

Notarized Record – A written record that has been signed, dated and stamped with the official notary stamp of a person acting as notary.

Person of Interest (POI) – The Person of Interest is the individual the criminal history information is concerning.

Record Attestation - A written document bearing the signature of an individual or official certifying that something is true.

Record of Arrest and Prosecution (RAP) – The RAP is a sheet that includes arrests and resulting dispositions.

Request Is Being Processed – The information entered is not unique and must be reviewed by a Criminal Records Technician.

Traffic Violations – Traffic violations occur when operators of cars, trucks, and motorcycles violate laws that regulate vehicle operation on streets and highways. This includes speed limits, traffic signal laws, and reckless driving statutes.

Examples of restrictions are:

• Arrests where no charges were filed are only included during the most recent year.
• Charges that were sent to diversion are only included during the most recent 2 years.
• Charges that were dismissed or acquitted.
• Any arrest where the person of interest was adjudicated in juvenile court will not be included.

Additionally:

• Minor traffic violations and crimes where the person of interest was issued a citation will not be included.

That part of criminal history record information consisting of a notation of an arrest, described in subsection (2) of section 29-3523, shall not be disseminated to persons other than criminal justice agencies after the expiration of the periods described in subsection (2) of section 29-3523 (restrictions listed above) except when the subject of the record:

1. Is currently the subject of prosecution or correctional control as the result of a separate arrest;
2. Is currently an announced candidate for or holder of public office;
3. Has made a notarized request for the release of such record to a specific person (Release of Information Form)

Should you require the information that may be excluded by §29-3523, and the person of interest does not fall under 1. or 2. you must submit a release form to the Criminal Identification Department. Once you’ve submitted your request, your receipt page will have links to the PDF notarized release forms you will need to send to the Nebraska State Patrol.
